In the California Public Utilities Commission’s ongoing Building Decarbonization Rulemaking (R.19-01-011), the Commission adopted a decision in 2023 (D.23-12-037) that eliminated electric line extension allowances, the 10-year refundable payment option, and the 50% discount option under Electric Tariff Rules 15 and 16 for mixed-fuel new construction, effective July 1, 2024. The Commission defined mixed-fuel new construction as building projects that use gas and/or propane in addition to electricity. The Commission also required mixed-fuel new construction projects to pay final actual electric line extension costs, rather than only estimated costs, effective January 1, 2025.

On June 9, 2026, the Morongo Band of Mission Indians submitted a letter to the Commission raising issues about the potential impacts of D.23-12-037 on Tribal communities located on Tribal trust lands. The Commission sent an Amended Scoping Memo and Ruling to Tribal leaders and staff on July 30, 2026. To more fully assess the application of certain parts of D.23-12-037, the Commission is accepting comments from the parties, potentially impacted Tribes, and the public.

The Commission will accept written comments from Tribal governments that are not formal parties to the proceeding and will docket these comments in the proceeding through a ruling issued by the assigned Administrative Law Judge. California Energy Commission (CEC)

Provide input through July 31, 2026

The California Energy Commission is holding an initial round of government-to-government consultations with California Native American Tribes to seek input on Energy Equity and Environmental Justice for the Integrated Energy Policy Report.

Every year the CEC is required to create an Integrated Energy Policy Report (IEPR) and “conduct assessments and forecasts of all aspects of energy industry supply, production, transportation, delivery and distribution, demand, and prices” (Public Resources Code (PRC) Section 25301(a)). These assessments and forecasts are used to develop recommendations for energy policies that conserve state resources, protect the environment, provide reliable energy, enhance the state’s economy, and protect public health and safety. The CEC includes these energy policy recommendations in its biennial Integrated Energy Policy Report that is issued in odd-numbered years, such as in the 2025 IEPR.

Further, PRC Section 25302(c) requires the CEC to prepare an update in alternate years to report on issues raised in the biennial IEPR or to identify new energy issues that have arisen during the intervening year. The Scoping Order for the 2026 IEPR Update can be found here.

The 2026 IEPR Update is currently under development, and we anticipate holding public workshops on the electricity demand forecast between July and December 2026. The CEC aims to release a draft report in fall or winter of 2026 and adopt the report in early 2027.

The 2026 IEPR Update will focus on the following topics: Geothermal; Justice Access Equity Diversity and Inclusion (JAEDI); and Demand Forecast.

California Energy Commission (CEC)

The CEC opened an Informational Proceeding on Tribal Affairs and Tribal Energy Sovereignty, that will result in several deliverables including best practices, policies, and a report. Those who would like to submit additional information for potential report inclusion may complete this form. Please only submit publicly shareable information. U.S. Office of Management and Budget (OMB)

The Office of Management and Budget (OMB) is accepting public comments on proposed changes to 2 CFR Part 200, the Uniform Guidance that governs most federal funding. Several proposed changes could impact Tribal governments, Native nonprofits, Tribal colleges, Native CDFIs, and other Native-serving organizations, including:

• Changes to fixed amount subawards
• New requirements related to reimbursement requests and drawdowns
• Updates to award oversight and termination provisions
• Additional review requirements before awards are issued
